Terms of Service

1. Scope

These Terms of Service (ToS) apply to the use of the SaaS service DMARCPulse (hereinafter "Service"), provided by Thorsten Dunker Investment GmbH, Ohmoor 95c, 22455 Hamburg, Germany (hereinafter "Provider").

By registering for and using the Service, the Customer accepts these Terms of Service.

2. Service Description

DMARCPulse is a web-based service for monitoring and analyzing DMARC reports for email domains. The Service includes:

  • Automatic retrieval and analysis of DMARC aggregate reports
  • Dashboard with statistics and visualizations
  • DNS configuration checks (SPF, DKIM, DMARC)
  • Actionable recommendations to improve email authentication
  • Alerting on configuration changes (depending on plan)

3. Contract and Duration

The contract is concluded upon completion of registration. The Base plan includes a free trial period of 7 days. After the trial period expires, the selected plan becomes chargeable.

Monthly subscriptions can be cancelled at any time effective at the end of the current billing period. Annual subscriptions can be cancelled effective at the end of the annual term.

4. Prices and Payment

Current prices are available on the website. Billing is processed through the payment service provider Paddle (Paddle.com Market Limited). All prices include applicable value-added tax (VAT) for EU customers. For US customers, applicable state and local sales taxes may apply and will be calculated at checkout by Paddle based on your billing address.

4.1 Refund Policy

Subscription fees are non-refundable. This applies to both monthly and annual subscriptions. Upon cancellation, the Service remains available until the end of the current billing period. No pro-rata refunds are granted for unused portions of a billing period.

The 7-day free trial on the Base plan allows the Customer to evaluate the Service before any charges apply.

5. Availability

The Provider strives to maintain a Service availability of 99% on an annual average. Planned maintenance will be announced in advance where possible. This excludes force majeure and disruptions beyond the Provider's control.

6. Data Protection

The handling of personal data is described in our Privacy Policy .

7. Liability

The Provider is liable without limitation for intent and gross negligence. For slight negligence, the Provider is only liable in the event of a breach of material contractual obligations. In such cases, liability is limited to the foreseeable, contract-typical damage.

7.1 Recommendations and DNS Changes

The actionable recommendations provided by the Service (e.g. DNS record suggestions for SPF, DKIM, or DMARC) as well as automated DNS changes via Domain Connect are non-binding suggestions based on the analyzed DMARC data. They do not constitute legally binding advice.

The Provider assumes no liability for damages arising from the implementation or automated application of these recommendations, in particular not for:

  • Misdirected, delayed, or undelivered emails
  • Faulty or incomplete DNS configurations
  • Unintended changes to existing DNS records via Domain Connect
  • Impact on third-party email deliverability

The Customer is solely responsible for reviewing and applying the recommendations to their DNS configuration. This applies in particular to automated changes via Domain Connect, which the Customer explicitly approves before execution.

7.2 Limitation of Liability

Without prejudice to statutory liability for intent and gross negligence, the Provider's total liability arising from and in connection with this contract — regardless of the legal basis — is limited in amount to the subscription fees actually paid by the Customer in the 12 months preceding the event giving rise to the damage.

8. Termination

The Customer may cancel the Service at any time via the account settings. Upon cancellation, data remains available until the end of the billing period.

8.1 Data Deletion

Upon expiry of a free trial without conversion to a paid subscription, all Customer data (including DMARC reports, DNS check history, and account data) is automatically and permanently deleted.

Upon cancellation of a paid subscription, Customer data remains available until the end of the billing period and is automatically deleted 30 days thereafter.

The Customer may export their raw DMARC report data at any time before deletion via the domain settings in the dashboard. The Provider recommends performing any desired exports before the subscription or trial period ends.

9. Governing Law and Jurisdiction

9.1 For Customers Outside the United States

The laws of the Federal Republic of Germany shall apply. The place of jurisdiction is the Provider's registered office, insofar as the Customer is a merchant.

9.2 For Customers in the United States

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of laws principles.

Any dispute arising out of or relating to these Terms or the Service shall be resolved exclusively in the state or federal courts located in the State of Delaware. You consent to the personal jurisdiction of such courts.

YOU AND THE PROVIDER EACH WAIVE ANY RIGHT TO A JURY TRIAL IN CONNECTION WITH ANY DISPUTE ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE.

10. Severability

Should any provision of these Terms of Service be or become invalid, the validity of the remaining provisions shall remain unaffected.
